A Federal Capital Territory (FCT) High Court, Wuse, yesterday summoned the Medical Director, Gwarimpa General Hospital, over the death certificate of one Peter Nwogu.
Justice M. Kolo issued the summon during the trial of a 31-year-old woman, Nneka Nwachukwu, standing trial for culpable homicide, punishable by death under Section 221 of the Penal Code Law.
Nwachukwu of Dape Village within the FCT was alleged to have poured acid on Nwogu resulting to his death.
Justice Kolo summoned the medical director to appear in court on January 25, 2016, to tender the death certificate of the deceased.
Earlier, the prosecuting counsel, Mr Patrick Ogele, had applied to the court to summon the medical director to tender the death certificate or give evidence on full medical report of the deceased.
Ogele said the report would aid the court in the successful prosecution of the case.
Counsel to the respondent, A.I. Moneke, however, objected to the application.
Moneke urged the court to discountenance the application, arguing that it was a deliberate attempt by the prosecution to delay the trial.
The lawyer also alleged lack of diligent prosecution of the trial against the prosecution. (NAN)
