Land tussle: Supreme Court affirms Awumi Agbabun right to Tsanku farm land

The Supreme Court in Abuja has affirmed the rights of people of Awumi Agbabun in Kupa district of Lokoja local government area of Kogi state to a parcel of land (Tsanku Farm land) located between Agini Agupo of Kupa district of Lokoja local government area of the state.

The decision follows the determination of the appeal filed by the people of Agini Agupo rejected the outcome of an appeal they filed before the Court of Appeal sitting in Abuja vesting the disputed land on the people of Awumi Agbabun.

The matter is the suit no number: SC 513/2012.

A community leader in Agini Agupo and Mallam Muhammad Jiya filed the appeal at the apex court.

At the proceedings, the people of Awumi Agbabun were represented at the trial by the duo of Mohammed Kanye Agbogbo Awumi and Sule Agbogbo Awumi.

The appellant who had lost his case at the lower courts sought the relief of the Supreme Court for the ownership of Tsanku land, faulting the judgment of the Court of Appeal on several grounds.

However, when the matter came up for hearing on the 16th of October 2023, the appeal filed by Jiya before the Supreme Court

since 2012 (11) years was struck out by the learned Justices of the Court for being incompetent.

The order striking out the appeal was made by, Justice Kudirat Kekere-Ekun who presided over the panel of five (5) Justices that heard the appeal.

“By this order made by the apex court, the judgments of the lower courts remain unshaken and subsisting and it further uphold and confirm the rights of the people of Awumi Agbabun to the disputed Tsanku Farm land,” the apex court held further.

The court verdict came after Mr. Chigbo Divine Anielozie representing the respondents and appellants’ counsel, U.M Ibrahim, made their presentations.
