A Kano state High Court presided over by Justice Muhammad Yahaya, has ordered the immediate arrest of the State Anti Corruption and Public Complaints Commission chairman, Muhyi Magaji Rimin Gado, for alleged contempt of court.
Magaji has been in a lingering battle with the High Court Judge, Justice Muhammad Yahaya, over alleged transfer of N100 million local joint account money lodged at the Stanbic Bank to a micro finance bank.
Muhyi had addressed a press conference accusing the judge of overstepping his judicial authority by issuing four exparte motions trying to stop investigation into the matter.
Justice Yahya yesterday through the state Chief Justice office, issued an order of arrest on the anti corruption boss on account of alleged contempt of court.
In the order signed by Justice Yahya he said, “at the last adjourned date, I made an order that the 1st Respondent/ Contemptor, Muhyi Magaji must be present in court and the order remains valid until set aside.” He added that, “the contemptnor is not in court today and contempt proceedings cannot be heard in the absence of the contemptnor.” “Therefore, I hereby order AIG Zone one Kano to immediately arrest 1st Respondent/Contemptnor in person Muhyi Magaji and to produce him before this Court on 18th July 2018.” He said nobody could be allowed to usurp the judicial power which is under section 6 of the 1999 constitution.
All efforts to speak to Muhyi Magaji Rimin Gado, the chairman of anti-corruption proved abortive as he was said not to have been in his office in the last two days and his phones were not going.
