State AG has power to take over criminal matter from police – Justice Lifu

A Federal High Court, sitting in Osogbo, Osun state capital, has held that the Attorney General of a state can take over any criminal matter from the police for prosecution

The complainant, one Alhaja Karimat Olounlomeru, a business woman, was allegedly duped to the tune of N3.2 by Messers Fasakin Adesakin,  Fasakin Temitope and Adenike Longe.

The complainant approached the Osun state Ministry of Justice to take over the matter from police, saying that the police did not handle the matter diligently.

Counsel to the accused, Mr Taiwo Awokunle, challenged the power of the state prosecutor to take over the matter.

But, Mr Faremi Moses, on behalf of the state, tendered a fiat of the Attorney General of the Federation, Abubakar Malami (SAN), granting the state ministry the power to prosecute Federal offences that happened in their respective states on behalf of the AGF.

In his Ruling, Justice Peter Odo-lifu, held that the state ministry has the power to take over any criminal matter from the police.
