Kaduna CJ reassigns land suit

Kaduna Chief Judge of Kaduna state, Justice Tanimu Zailani, has reassigned the case between Mr. Lawrence Enyesiobi and Col. John Ubah (retd) from state High Court 10 to 13 while fi xing hearing for August 2, 2017. Th is was in response to an application and appeal for transfer of the case from Justice Bashir Sukola by the defendant, Ubah dated June 20, 2017. He had observed in his application for transfer that Justice Sukola was acting in a manner he thought was not for true justice and rule of law, noting that he felt the outcome of the suit may be compromised if the judge was left to handle it.

Ubah said his argument was based on what happened when Nnamdi Kanu of the Indigenous People of Biafra (IPOB) had asked that Justice Tsoho hands off his case and that his case be re-assigned. Justice Sukola had earlier told the Court that the appeal and application was a personal letter to him, and, therefore, he would not honour the application as a request. According to Ubah’s application, he had expressed dismay at what he called the failure by Chief Judge Tanimu Zailani to reply his application for re-assignment as a constitutional breach of confi dence in fair play to all parties in the justice system. It would be recalled that Col. Ubah had on June 2, 2017 applied for the reassignment of his case with Mr. Lawrence Enyesiobi from Justice Sukola of State High Court 10 for what he called personal interest of the Judge in the case, which he added contradicts the provisions in the code of conduct for judicial offi cers of the Federal Republic of Nigeria, Rule 2 (c) that calls for disqualifi cation of such judicial offi cer
