Impeachment: Court adjourns on Shekarau’s suit against Plateau assembly

Plateau state High Court 1, presided over by Justice P. D. Damulak, yesterday adjourned a matter pending before it challenging the House of Assembly over the impeachment of its former Deputy Speaker, Hon. Johnbull Shekarau.

The matter which was slated for hearing could not go on following the filling of three motions on notice by the defence counsel.
The applications which have five paragraphs in supports sought an extension of time to enable the defence regularise their processes, an order of the court to file memorandum of appearance out of time.

Defence counsel, Dr. F.M Kwede, had also sought from the court an order to allow them file counter affidavit out of time.
On his part, the plaintiff’s counsel, Barrister Bonifice Ngyou, raised no objection to the motion, but sought for cost.

In his ruling, Justice Damulak granted all the relief sought, awarded the cost of N10, 000 only to the plaintiff.
Shekarau had dragged the House of Assembly to the court seeking its determination on wither his removal was in tandem with the constitutional provision, as well as that of the house standing rules.

Shekarau is also seeking an order of the court to nullify his  impeachment and subsequently reinstate him and further order instructed for the payment of all previous entitlements.
The matter was adjourned to 25 March 25, 2014.
