Group wants Jonathan, minister to intervene in land encroachment

A group, Lugbe CRD Landlords Association, has called on President Goodluck Jonathan and the Minister of the Federal Capital Territory, Senator Bala Mohammed, to intervene and stop the illegal and contemptuous encroachment by the River Park Estates and or Houses for Africa Nigeria Limited.

The group made the call during a briefing by the association’s secretary, Mr. Bem Aga, in Abuja.
Aga while briefing journalists said despite an interim injunction issued to on April 25, 2014 by Honourable Justice A.I Kutigi of the FCT High Court 24 Apo, restraining the company and its agents from going ahead with their trespassing activities pending the determination of the matter on notice, River Park Estates and or Houses for Africa Nigeria Limited continued to violate same.
The association’s secretary also noted for the records that the authority of the federal capital territory had at no time withdrawn the allocation titles given to occupants of lands acquired by its members.

He said: “With the benefit of hindsight and in the interest of justice and the rule of law, we call on President Goodluck Jonathan (GCFR), Senator Bala Mohammed, Minister of the Federal Capital Territory, the FCT Administration and Development Control to stop the illegal and contemptuous encroachment into our land by the River Park Estates and or Houses for Africa Nigeria Limited.
“The company has continued trespassing on our land in violation of an interim injunction issued to our colleagues on April 25, 2014 by Honourable Justice A.I Kutigi of the FCT High Court 24 Apo, retraining the company and its agents from going ahead with their trespassing activities pending the determination of the matter on notice.”

Citing a ruling on March 25, 2011, by Honourable Justice Peter O. Affen of the Abuja High Court, Aga said “the purported land documents the River Park Estates and or Houses for Africa Nigeria Limited has been operating within Lugbe, have been declared null and void and of no consequence in a ruling which has not been set aside or successfully appealed.”
The secretary lamented that the company, River Park Estates, and or Houses for Africa Nigeria Limited, when confronted by the association, had boasted of having the consent and approval of high connections in government, all of whom gave the go ahead for such illegal encroachment.
