ASJ Global links vs Kano govt: Court to rule June 16

Kano state High Court presided over by Justice Ibrahim Musa Karaye has slated June 16, 2014, to rule on the Stay of Execution of judgement delivered on the February 20, 2014, which ordered the state Chief Judge to appoint a single arbitrator who would settle the dispute between ASJ Global Links and the Kano state government over the contract of 31 vehicles supplied by the plaintiff to the defendants.
Dissatisfying with the judgement, the state government through its counsel, Barister Usaini Saifullahi, moved an application praying the court for the stay of execution pending the determination of Court of Appeal.

In his argument, Saifullahi said the judgement delivered on February 20 was declaratory and an executive order, adding that by the nature of the orders, the Chief Judge had become party to the matter, and, therefore, prayed the court to grant his application of stay of execution.
And in his response, the counsel to ASJ Global Links, Olajide Ayodele, said the balance of conveniences was in favour of his client, adding that none of the orders directed the Chief Judge to behave in different ways.

He said the firm was not at this stage claiming its money, but asking the court to appoint a single arbitrator who would settle their dispute amicably.
It would be recalled that the AsJ Global Links had supplied 31 vehicles  to the Kano state government at the sum of N493 million under the tenure of Malam Ibrahim Shekarau.
However, the present administration declined to pay the amount to the plaintiff alleging that there was falsification and fraud in the contract.
But the judgement of the court delivered on January 20, this year, held that the parties observed due process in the said contact.
