Appeal Court upholds Kwankwaso’s election

The Court of Appeal sitting in Kaduna yesterday dismissed the suit instituted by Hassan Sani Indabawa and Suleiman Mohammed against Governor Rabiu Musa Kwankwaso contesting his eligibility to vie for the 2011 governorship election.
Indabawa and Mohammed in a suit are appealing the judgement of the Federal High Court sitting in Kano which upheld the election of Kwankwaso as the elected governor of Kano state.

The appellants through their counsel had filed a motion on notice seeking the disqualification of the defendant from contesting the 2011 governorship election of Kano state on the basis that he lied on his nomination form.
But Justice Habeeb Abiru, who presided over the case, upheld the election, dismissed the case and referred the parties back to the Kano state Federal High Court, saying that the court lacked jurisdiction to hear the case.

Counsel to Kwankwaso, Musa Lawal, who applauded the court’s ruling, told reporters that “we are going back to the Kano Federal High Court to continue with the matter even though we still have an option to go further, if we feel that we should go further then we will take the decision.”
However, counsel to Indabawa, Abdul Adamu, who took over the case from Nasir, said if his client gives him the go ahead, they would take the matter further to the Supreme Court to challenge the decision of the Court of Appeal.
He said as far as the Court of Appeal was concerned, it affirmed the judgement delivered by the Federal High Court in Kano.
