Appeal court suspends judgment against Alex Otti

The Court of Appeal in Kano has suspended the judgment delivered by a Federal High Court that invalidated the primaries which resulted in the selection of Alex Otti and other Labour Party (LP) candidates in Abia state.

The decision, handed down by Justice Mbaba on Saturday, includes the granting of Alex Otti’s application to appeal as an interested party. Consequently, the judgment of the Federal High Court has been temporarily put on hold until the appeal is heard and determined.

This order from the Court of Appeal is in response to the motion for leave submitted by the Abia Governor-Elect, who sought permission to appeal as an interested party against the May 18, 2023 judgment of the Kano Division of the Federal High Court (Suit No. FHC/KN/CS/107/2023).

Moreover, the Appellate Court has granted an order to stay and suspend the judgment issued by Justice Yunusa J. of the lower court.

The suspension will remain in effect until the appeal, for which leave has been granted, is heard and resolved.
